License Agreement

Note: the SOFTWARE name will change for each program. And this document will be shown after installation of the software.

SOFTWARE LICENSE for Tank Heat Loss And Insulation Calculations for a Single User (the CUSTOMER)

1. GRANT OF LICENSE. Neal Blackburn Management Services, Inc.(the OWNER) grants to the CUSTOMER the right to use one copy of the enclosed Tank Heat Loss and Insulation Calculations software program {the SOFTWARE} on a single terminal connected to a single computer (i.e. with a single CPU).

2. COPYRIGHT. The SOFTWARE is owned by OWNER or its suppliers and is protected by Canada's copyright laws and international treaty provisions. CUSTOMER may make one copy of the SOFTWARE solely for backup or archival purposes, or transfer the SOFTWARE to a single hard disk provided the CUSTOMER keeps the original solely for backup or archival purposes.

3. OTHER RESTRICTIONS. CUSTOMER may not rent or lease the SOFTWARE, but CUSTOMER may transfer the SOFTWARE on a permanent basis provided CUSTOMER retains no copies and the recipient agrees to the terms of this Agreement, all subject to prior approval of OWNER.

4. CUSTOMER may not reverse engineer, decompile or disassemble the SOFTWARE. 

5. CUSTOMER agrees that it is responsible for determining that all information, provided herein to the CUSTOMER, is sufficiently accurate for the CUSTOMER'S purposes.

6. DISCLAIMER. The designer and the corporation issuing this SOFTWARE have used their best efforts in preparing this SOFTWARE and the calculations contained in it. These efforts include the development, research and testing of the formulae and the SOFTWARE to determine their effectiveness. The designer and the corporation make no warranty of any kind, expressed or implied, with regard to this SOFTWARE or the documentation contained in this SOFTWARE. The designer and the corporation shall not be liable in any event for incidental or consequential damages in connection with, or arising out of, the furnishing, performance, or use of this SOFTWARE.

7. CUSTOMER REMEDIES. The OWNER'S entire liability and the CUSTOMER'S exclusive remedy shall be the OWNER'S option either to (a) return the price paid or (b) repair or replace the SOFTWARE if the SOFTWARE fails and the SOFTWARE is returned with a copy of the CUSTOMER'S receipt if downloaded ( receipt and registration number if a CD is supplied). The foregoing is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. CUSTOMER REMEDIES are in effect for 37 days from the date printed on CUSTOMER'S receipt. 

This agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
